Welcome to CLIFFSIDE FITNESS (“Company,” “we,” “our,” or “us”). These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“you,” “your,” or “Client”) and CLIFFSIDE FITNESS regarding your access to and use of our website (cliffsidefitness.com or any successor domain), mobile applications, digital products, physical goods (including apparel), fitness services, coaching programs, community groups, and all related features, content, and communications (collectively, the “Services”).

By accessing or using any part of the Services—including but not limited to browsing our website, creating an account, booking a session, purchasing a product, downloading digital content, joining a program, or participating in the Morning Check-In—you expressly acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy (incorporated herein by reference). If you do not agree to all terms herein, you must immediately discontinue use of the Services.

CLIFFSIDE FITNESS operates on principles of transparency, personal responsibility, holistic wellness, and mutual respect. We integrate physical training, mental resilience, and faith-centered encouragement—but we also uphold safety, informed consent, and clear boundaries. These Terms reflect that commitment.

TERMS OF SERVICES

CLIFFSIDE FITNESS is a fitness and wellness brand headquartered in New Haven, Connecticut. Our mission is to empower individuals through a body–mind–spirit approach to health. We offer the following Services:

  • Mobile Personal Training: In-home, gym-based, or outdoor one-on-one sessions
  • Online Coaching & Virtual Fitness Programs: Structured digital plans delivered via email, video, or app
  • Small Group Training: Limited-capacity in-person or virtual group sessions
  • Injury Recovery & Comeback Programs: Non-medical fitness support for post-injury reconditioning
  • Faith-Centered Wellness Coaching: Optional spiritual encouragement integrated with fitness goals
  • Digital Training Programs: Downloadable guides, video libraries, and self-paced curricula
  • Branded Apparel: Performance and lifestyle clothing sold via our online store
  • Community Offerings: Including the Morning Check-In—a free, invitation-only Zoom group for accountability and mindset development

All Services are voluntary, non-medical, and designed for general fitness, motivation, and educational purposes only.

ELIGIBILITY & USER REPRESENTATIONS

To use our Services, you represent and warrant that:

  • You are at least 18 years of age, or if under 18, you have obtained verifiable consent from a parent or legal guardian, who must also agree to these Terms on your behalf.
  • You are legally competent to enter into a binding contract.
  • You understand the physical, emotional, and mental demands of fitness activities.
  • You accept full personal responsibility for your participation, choices, and outcomes.
  • If booking or using Services on behalf of another person (e.g., a minor, family member, or organization), you confirm you have legal authority to bind them and assume liability for their conduct and compliance.

We reserve the right to request proof of age or guardianship at any time.

SCOPE OF SERVICES & PROFESSIONAL LIMITATIONS

CLIFFSIDE FITNESS provides fitness instruction, wellness education, and motivational support only. We do not provide:

  • Medical diagnosis, treatment, or advice
  • Physical therapy, occupational therapy, or rehabilitation services
  • Psychological, psychiatric, or counseling services
  • Emergency care or crisis intervention

Important: Our Services are not substitutes for professional healthcare. You are solely responsible for consulting with a licensed physician, physical therapist, or mental health provider before beginning any fitness or wellness program—especially if you have pre-existing conditions, injuries, pregnancy, cardiovascular issues, or other health concerns.

By participating, you confirm you have either (a) received medical clearance, or (b) knowingly waive such consultation at your own risk.

HEALTH DISCLAIMER & ASSUMPTION OF RISK

You acknowledge that physical activity carries inherent risks, including but not limited to:

  • Muscle strain, joint sprains, or soft tissue injury
  • Cardiovascular stress or fainting
  • Aggravation of prior injuries or undiagnosed conditions
  • Slips, falls, or environmental hazards (e.g., uneven terrain, weather)
  • Equipment malfunction or misuse

You voluntarily assume all risks associated with participation—whether known or unknown, foreseeable or unforeseeable. You further agree that:

  • You are physically and mentally capable of engaging in the selected activities.
  • You will immediately stop and notify your coach if you experience pain, dizziness, shortness of breath, or discomfort.
  • You will disclose all relevant medical history prior to your first session.
  • Results are not guaranteed and depend on individual effort, consistency, genetics, nutrition, sleep, and lifestyle factors.

CLIFFSIDE FITNESS shall not be liable for injuries resulting from:

  • Failure to follow instructions or safety guidelines
  • Concealment of medical conditions or limitations
  • Use of improper, damaged, or client-provided equipment
  • Activities performed outside scheduled or supervised sessions

MOBILE TRAINING SERVICES

Our mobile training may occur at locations designated by you, including private residences, public parks, gyms, or other approved venues.

By booking mobile training, you agree to:

  • Ensure the space is safe, clean, well-lit, and free of hazards (e.g., loose rugs, pets, clutter).
  • Obtain all necessary permissions to use the location (e.g., landlord approval, gym membership).
  • Assume full responsibility for the environment, including third-party property damage or liability.

CLIFFSIDE FITNESS is not liable for injuries, theft, or damages occurring due to unsafe, unauthorized, or unsuitable locations provided by the Client.

ONLINE COACHING & VIRTUAL PROGRAMS

Digital Services (e.g., video workouts, PDF guides, app-based plans) are delivered electronically. You understand that:

  • Online training requires self-discipline, proper form awareness, and environmental safety.
  • You are solely responsible for executing exercises correctly without real-time supervision.
  • Internet connectivity, device compatibility, or platform outages are beyond our control.
  • No refunds are issued for accessed, downloaded, or partially used digital content (see Section 11).

We strongly recommend filming yourself or consulting a local trainer to verify form when starting a new program.

MORNING CHECK-IN GROUP

The Morning Check-In is a complimentary, invitation-only Zoom community session focused on mindset, accountability, and daily intention-setting.

  • Participation is entirely voluntary and not a substitute for therapy, counseling, or medical care.
  • All participants must adhere to our Code of Conduct: respectful, non-judgmental, and inclusive language only.
  • CLIFFSIDE FITNESS reserves the right to deny entry, mute, remove, or ban any participant for disruptive, offensive, or inappropriate behavior—without refund or notice.
  • Recordings, if made, are for internal quality assurance only and will not be shared publicly without consent.

FAITH-CENTERED CONTENT DISCLAIMER

CLIFFSIDE FITNESS may incorporate optional spiritual or faith-based perspectives (e.g., references to purpose, hope, or scripture) as part of its holistic wellness philosophy.

  • No religious affiliation or belief is required to participate.
  • Content is shared for encouragement and personal reflection only, not as doctrinal instruction.
  • We do not provide pastoral counseling, religious rites, or theological guidance.
  • Clients may opt out of faith-centered elements at any time by notifying us in writing.

BOOKINGS, PAYMENTS & FEES

  • All pricing, packages, session rates, and product costs are displayed at checkout or upon booking.
  • By completing a transaction, you authorize CLIFFSIDE FITNESS to charge your selected payment method (credit card, PayPal, etc.) for the full amount.
  • You warrant that all billing information (name, address, card details) is accurate and authorized.
  • Prices are subject to change with 30 days’ notice for recurring services; changes do not affect already confirmed/paid bookings.
  • Late payments may incur fees or result in service suspension.

CANCELLATION & NO-SHOW POLICY

Personal Training & Coaching Sessions

  • Cancellations require at least 24 hours’ advance notice via email or our booking system.
  • Late cancellations (<24 hrs) or no-shows will be charged the full session fee.
  • Three (3) unexcused no-shows within 60 days may result in termination of services without refund.

Online Programs & Digital Products

  • All sales are final upon download or access.
  • No refunds for completed, opened, or used digital content.

CLIFFSIDE FITNESS may cancel sessions due to illness, emergency, or force majeure, with rescheduling or credit offered at our discretion.

REFUNDS & RETURNS

Services

  • Refunds for live services (training, coaching) are not guaranteed and reviewed on a case-by-case.
  • Requests must be submitted in writing within 7 days of the incident.
  • Credits may be issued in lieu of cash refunds.

Apparel & Physical Goods

  • Returns/exchanges accepted within 14 days of delivery.
  • Items must be unworn, unwashed, with original tags and packaging.
  • Customer pays return shipping; original shipping fees are non-refundable.
  • Final sale items (e.g., clearance) are excluded.

Digital Products

  • Non-refundable once accessed or downloaded.

RESULTS DISCLAIMER

CLIFFSIDE FITNESS makes no guarantees regarding specific outcomes, including but not limited to:

  • Weight loss or body composition changes
  • Strength, endurance, or performance gains
  • Pain reduction or injury recovery
  • Mental health improvements

Individual results depend on numerous factors beyond our control. Testimonials reflect personal experiences and are not typical or guaranteed.

INTELLECTUAL PROPERTY

All content on our website and within our Services—including text, graphics, logos, images, videos, audio, training methodologies, program structures, workout plans, and software- is the exclusive property of CLIFFSIDE FITNESS or its licensors, protected by U.S. and international copyright, trademark, and intellectual property laws.

You may not:

  • Copy, reproduce, or distribute content without written permission
  • Reverse engineer, decompile, or extract code
  • Use CLIFFSIDE FITNESS branding for commercial or promotional purposes
  • Create derivative works based on our materials

Unauthorized use will result in cease-and-desist notices and potential legal action.

USER CONDUCT

You agree not to:

  • Use the Services for any illegal, fraudulent, or harmful purpose
  • Harass, threaten, defame, or impersonate others
  • Upload viruses, malware, or disruptive code
  • Interfere with server functionality or network security
  • Attempt to gain unauthorized access to accounts, data, or systems

Violations may result in immediate termination of access, reporting to authorities, and legal remedies.

TESTIMONIALS & USER-GENERATED CONTENT

By submitting reviews, photos, videos, or messages to CLIFFSIDE FITNESS (via email, social media, or forms), you grant us a worldwide, royalty-free, perpetual license to use, edit, and display such content for marketing, advertising, and promotional purposes—unless you explicitly request otherwise in writing.

You represent that you own or have rights to share the content and that it does not violate third-party rights.

THIRD-PARTY LINKS & INTEGRATIONS

Our website may link to or integrate with third-party services (e.g., Stripe, PayPal, Zoom, Instagram, YouTube). These links are provided for convenience only.

CLIFFSIDE FITNESS does not endorse, control, or assume responsibility for:

  • Third-party content, accuracy, or privacy practices
  • Payment processing errors or disputes
  • Platform outages or data breaches on external sites

Your interactions with third parties are governed by their own terms and policies.

LIMITATION OF LIABILITY

To the fullest extent permitted by Connecticut law, CLIFFSIDE FITNESS, its owner(s), employees, contractors, and affiliates shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the Services, including but not limited to:

  • Personal injury or death
  • Lost profits, income, or business opportunities
  • Emotional distress or mental anguish
  • Property damage or data loss

Our total liability for any claim related to the Services shall not exceed the amount you paid to us in the six (6) months preceding the claim.

INDEMNIFICATION

You agree to defend, indemnify, and hold harmless CLIFFSIDE FITNESS and its representatives from any claims, damages, losses, liabilities, costs, or expenses (including attorneys’ fees) arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your breach of any representation or warranty
  • Your negligence or misconduct

We reserve the right to assume exclusive defense and control of any matter subject to indemnification.

TERMINATION

CLIFFSIDE FITNESS may, at its sole discretion:

  • Suspend or terminate your access to the Services
  • Cancel active programs or bookings
  • Refuse future service

…with or without cause, notice, or refund, particularly in cases of abusive behavior, non-payment, safety concerns, or violation of these Terms.

Upon termination, all licenses granted herein cease immediately.

GOVERNING LAW & DISPUTE RESOLUTION

These Terms are governed by and construed in accordance with the laws of the State of Connecticut, without regard to conflict-of-law principles.

Any dispute arising from these Terms or the Services shall be resolved exclusively in the state or federal courts located in New Haven County, Connecticut. You consent to personal jurisdiction and venue in those courts.

Waiver of Class Actions: You agree to resolve disputes individually and waive any right to participate in class, collective, or representative actions.

CHANGES TO TERMS

We may update these Terms periodically to reflect changes in our Services, legal requirements, or business practices. The “Last Updated” date at the top will reflect revisions.

Continued use of the Services after changes constitutes acceptance of the updated Terms. We encourage you to review this page regularly.

For material changes, we may provide email notice or prominent website alerts.
